FCRA Compliance, Safe Harbor & Consumer Dispute Protocol
VaraX Data Technologies Inc. operates in strict compliance with the federal Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.), the Gramm-Leach-Bliley Act (GLBA), and state consumer reporting regulations. This document outlines subscriber permissible purpose requirements, mandatory adverse action procedures, and consumer dispute rights.
1. Permissible Purpose Verification (15 U.S.C. § 1681b)
Under Section 604 of the FCRA, consumer reporting agencies may only furnish consumer reports under specific statutory permissible purposes. VaraX restricts API underwriting access strictly to commercial subscribers who certify:
Evaluating an applicant seeking to enter into a residential tenancy or lease agreement.
In accordance with the explicit, verifiable written consent and authorization of the consumer.
2. Mandatory Adverse Action Notices (15 U.S.C. § 1681m)
If a property manager, landlord, or institutional subscriber takes any adverse action against an applicant (such as denying a lease application, requiring a co-signer, or increasing deposit or rent amounts) based in whole or in part on information provided by VaraX, the subscriber is legally required to furnish the applicant with an Adverse Action Notice.
- Name, address, and toll-free contact details of VaraX Data Technologies Inc.;
- A clear statement that VaraX compiled the telemetry report but did not make the decision to take adverse action and cannot explain why the decision was made;
- Notice of the consumer's statutory right to obtain a free copy of their report within 60 days;
- Notice of the consumer's right to dispute the accuracy or completeness of any information with VaraX.
3. Consumer Dispute Portal & 30-Day Reinvestigation (15 U.S.C. § 1681i)
If you have been screened using the VaraX network and believe that any information contained in your report is inaccurate, out-of-date, or incomplete, you may submit an expedited dispute below or email compliance@varaxdata.com.
VaraX investigates all consumer disputes free of charge and will conclude reinvestigation within 30 business days. Any data point that cannot be verified will be promptly expunged.
